Purposes and statutory regulations of data processing
COLLIERS processes personal data of applicants in the context of application procedures for the evaluation of the pro-fessional and personal abilities of the applicants and for the filling of vacancies.
Data processing in the context of application procedures is based on the legal basis of consent pursuant to Article 6 (1) (a) GDPR, the precontractual measures pursuant to Article 6 (1) (b) GDPR and the legal basis of legitimate interest pur-suant to Article 6 (1) (f) GDPR, namely the interest of checking the suitability of the applicant for a specific position in the company. If you want to become an employee of COLLIERS, meaning you want to enter into a contractual relation-ship with COLLIERS, you are obliged to provide the personal data necessary for the creation of this contract. Failure to provide it would result in COLLIERS not entering into a contract with you.
Recipient of the data
We save and process the personal data transmitted or disclosed to us only insofar as it is related to the processing of the application process. We disclose your data
- only to the minimum extent necessary, that is, insofar as it is necessary for the fulfilment of the contract
- solely if there is a legal basis, a valid consent from your side, or a legitimate interest to support the disclosure of your data.
Potential recipients may be: departments at COLLIERS involved in the application process (e.g., IT, HR department) or companies within the corporate group (e.g., collaborative recruitment), service providers of the responsible person (e.g., tax consultant, lawyer) as well as authorities (social insurance, tax office, BUAK, other authorities), or companies who work as our contractors in the context of IT infrastructure support (software, hardware). With each potential recipient, we have signed the appropriate contract for data processing in accordance with the GDPR.
Data transmission to a third country
It may be necessary for COLLIERS to transfer personal data to companies outside Austria and outside the European Economic Area. In some of these countries, the level of data protection is lower than in the European Union.
If COLLIERS forwards personal information, appropriate security measures are taken to ensure adequate protection for the transfer of data. It is possible to obtain a copy of these security measures from your contact person at COLLIERS.
Duration of data storage
Personal data that we process will only be stored until the purpose for which we process it is fulfilled. For application procedures, the data will be stored up to 7 months after the end of the application process if no contractual relationship is reached. In case you give us consent to keep your data on file for future reference, we will store your data until you revoke your consent.
The General Data Protection Regulation grants you the following rights in connection with the collection and storage of your personal data:
- Right to be informed about the processing of your personal data
- Right to rectification, erasure or restriction of processing
- Right to object to processing
- Right to data portability
If you believe that the processing of your data violates data protection law or your data protection claims have other-wise been violated in any way, you can complain to the data protection authority.
If the data processing is based on your consent, you can revoke your consent to data processing at any time by writing to email@example.com (an e-mail is sufficient). A revocation does not affect the legality of the processing carried out before the revocation, as it was based on your consent at the time.
Data security and cyber security
Your data is hosted by a provider located within the European Union. Both COLLIERS and the provider use technical and organizational security measures to protect your data against manipulation, loss, destruction or access by unau-thorized persons. Notwithstanding our efforts to maintain an appropriately high standard of due diligence, it cannot be ruled out that information you provide to us over the internet can be viewed and used by others.
Please note that we therefore assume no liability whatsoever for any potential disclosure of information due to errors in the data transfer process and/ or unauthorized access by third parties (i.e. hacking of an email account or telephone, or interception of faxes).
