New site development law

On 21st Dec.2018, the much-discussed new site development law passed the Council of Ministers. Among other things, the law provides for an acceleration of the environmental impact assessment of site-relevant (large) projects.

In the first draft legislation, an automatic mechanism was envisaged, which considers projects, which are certified by ordinance as of "special public interest", as EIA-approved after one year, if the decision is still pending.

This first draft had caused a lot of criticism, which is why in the current version said automatism is no longer provided. However, the acceleration of first-instance proceedings to a maximum of 18 months is envisaged.
